UKB Networks Acceptable Use Policy (AUP)

This Acceptable Use Policy (AUP), which may be subject to change from time to time, must be read in conjunction with our terms and conditions and the Additional Terms for the relevant Service and are available on request. You, nor any End User to which you may resell services, may not use the Service for any purpose that is unlawful and/or otherwise prohibited by this Acceptable Use Policy.

The term “Service” shall include, without limitation, LTE or other broadband access technology, Microwave Ethernet, Ethernet, Leased Line access circuits or service and/or other services provided by UKB Networks Limited whether directly or indirectly to an End User, together with the website http://www.ukbnetworks.com and any products and/or services offered on and/or through our website or Partner Portal.

The website http://www.ukbnetworks.com and includes a Partner Portal (for the purposes of this AUP, “Website“) are owned or operated by UKB Networks Limited and the services offered by UKB Networks Limited, whether on and/or through the Website and whether provided directly or indirectly are services provided UKB Networks Limited (“UKBN”).

Fair Use Policy Guidelines, where applicable, are available separately from UKBN and are also subject to revision from time to time.

Acceptance of Acceptable Use Policy

1.1 By using the “Service‟ you shall be deemed to have accepted this Acceptable Use Policy. If you do not accept the terms of this Acceptable Use Policy, you must cease use of the Service with immediate effect.

1.2 UKBN reserves the right to make changes to this Acceptable Use Policy from time to time. You should visit the Website from time to time to ensure you have the current version. Your continued use of the Services shall signify your acceptance of any changes to the Acceptable Use Policy.

1.3 Additional terms and conditions apply where you enter into any contract with UKBN for UKBN goods and services via the Website or otherwise and this Acceptable Use Policy is hereby incorporated into and forms part of the contract that you have with UKBN.

Acceptable Use Policy

2.1 UKBN provides services for access to the Internet and does not actively monitor use of the Service under normal circumstances. Notwithstanding this, UKBN may monitor the bandwidth consumed when using the service, conduct random checks or investigations from time to time to ascertain compliance with this Acceptable Use Policy and to comply with or investigate any enforcement agency or police request or other complaints. In using the Service you, nor shall your End Users shall not:

2.1.1 say or do anything that would cause annoyance, inconvenience, harassment or needless anxiety to others;

2.1.2 advertise or promote third party or your own products or services by way of the distribution of ‘spam’ mail;

2.1.3 use foul, threatening, offensive language, or sexually explicit language;

2.1.4 make insulting remarks to or about other users of the Service to engage in any defamatory behaviour;

2.1.5 distribute illegal, copyright infringing, intellectual property right infringing, indecent or offensive material or any messages or content that may incite disorder or encourage illegal activities or that causes or may cause harm to minors;

2.1.6 impersonate UKBN or another person, company or group;

2.1.7 transfer files that contain viruses, trojans or other harmful programs;

2.1.8 use the Service to conduct any fraudulent activity including, without limitation, any “pyramid scheme”, “ponzi scheme” or “chain letter”;

2.1.9 breach or otherwise fail to comply with relevant licence terms in connection with any hardware, software or licensed content that you access via the Service;

2.1.10 connect any insecure computer hardware or telephony device or other machines to the Service which may be exploited by third parties to carry out activities that are in breach of this Acceptable Use Policy;

2.1.11 access or attempt to access the accounts of other users or to penetrate or attempt to penetrate the Website or UKBN’s security measures; and/or

2.1.12 use the Service or any service in such a way that interrupts, impairs or interferes with or may, in UKBN’s reasonable opinion, interrupt, impair, degrade or interfere with UKBN systems and/or services provided to other UKBN customers.

Copyright and Other Intellectual Property Rights

3.1 Your use of the Service grants no rights to you in relation to any copyright, trademarks or other of UKBN’s intellectual property rights or the intellectual property rights of third parties including UKBN’s licensors.

3.2 You may not, without limitation, copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, communicate to the public, or otherwise use the content included in or provided via the Service except for your own personal, non-commercial use or where UKBN expressly gives you a right to do so on a case-by-case basis.

Consequences of breach of this AUP

4.1 UKBN may take any or all of the following actions at its sole discretion:

4.1.1 remove any material that, in UKBN ‘s sole discretion may be deemed inappropriate or that UKBN may suspect to be illegal, may subject UKBN to liability, damage UKBN’s reputation or which may violate this Acceptable Use Policy or where UKBN is required to do so by law;

4.1.2 issue you with verbal or written warnings and take such further action as UKBN deems appropriate if you do not comply with the warnings;

4.1.3 suspend or terminate your access to any or all of the Service without notice at any time;

4.1.4 inform the appropriate authorities and provide them with information regarding any suspected illegal activity; and/or

4.1.5 bring legal action against your or any other user in relation to any breach by you or such other user of this Acceptable Use Policy or any illegal or suspected illegal activity.

4.2 Your breach of this Acceptable Use Policy may also give rise to termination of or further action under any other contract that you may have with UKBN.

4.3 You acknowledge that UKBN may be required by law or regulation to access, monitor, store or copy material sent by you or to you or other users without further notice.

4.4 In addition to the obligations set out in Clause 2.1, you agree that in using the Service you will at all times comply with all relevant laws and regulations.

4.5 You agree that you shall, upon demand, indemnify and hold harmless UKBN for any loss or damage that may be caused to UKBN (including reasonable legal costs) as a consequence of your breach of this Acceptable Use Policy.
